“you”/”your” means the user of the Website including users who has registered with us and where applicable,

1. Nature of Our Services
HR Partner operates strictly as a digital job search marketplace and advertising medium connecting hiring employers with job seekers.
- The Pipeline: We provide infrastructure for employers to list vacancies and for candidates to submit contact details.
- No CV Storage: We do not host a central database of candidates, nor do we store or retain CVs post-transmission.
- No Recruitment Intervention: We are not a traditional transactional recruitment agency. We do not screen, interview, vet, or select candidates. The entire selection, interview, and contracting process is handled directly between the candidate and the employer.
- Our platform serves as a direct routing pipeline; we do not collect, host, or retain your CV or application files on our servers once they have been successfully transmitted to the employer.
2. Marketplace Disclaimers & Limitation of Liability
The Website content and information may contain technical inaccuracies and typographical errors. We exclude all liability for any illegality arising from such inaccuracies and typographical errors. The content of and information appearing on the Website may be altered, amended or updated from time to time and may at times be out of date. We will not be held to any previously existing representations, terms, conditions or other information subsequently altered on the Website. We accept no responsibility for keeping the information and content on the Website up to date nor do we accept any liability for any failure to do so. The information appearing on the Website is for information purposes only and does not constitute advice. You should not rely on any such information or content to make (or refrain from making) any decision or take (or refrain from taking) any action. Through the Website, we present advertorial content and information submitted and created by companies and other third parties. We exclude all liability for any illegality arising from or error, omission or inaccuracy in such content and/or information. A. For Candidates / Job Seekers;
- No Guarantee of Employment: Applying for a vacancy through our platform does not guarantee that an employer will review your application, contact you, schedule an interview, or offer you employment.
- Employer Actions: We have no control over, and accept zero liability for, the hiring practices, communication timelines, or operational decisions of the third-party employers who advertise on our platform.
B. For Corporate Clients / Hiring Employers;
- No Candidate Vetting: We do not verify, screen, or background-check the individuals applying to your listings. We do not guarantee the accuracy, truthfulness, or validity of any applicant's name, contact details.
- Responsibility to Screen: It is your sole responsibility as an employer to perform due diligence, reference checks, qualification verifications, and interviews in compliance with South African labor laws.
C. General Limitation;
The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by South African law, we exclude all liability for any direct, indirect, incidental, or consequential loss or damage (including loss of data, profit, or opportunity) arising from your use or inability to use the platform, or from the interactions that occur between candidates and employers off the platform.
3. User Obligations & Accuracy of Data
Whether you are a candidate or an employer, you agree that all information you input into our platform will be truthful, accurate, complete, and legally compliant..
- Candidates: You may only submit your own genuine personal information. You are responsible for ensuring your contact details are typed error-free so employers can reach you.
- Employers: You are entirely responsible for the legality and accuracy of the job listings you post or supply. You warrant that your vacancies comply with the Employment Equity Act, Basic Conditions of Employment Act, and all other applicable South African legislation.
4. System Security & Prohibited Activities
You may not use this website maliciously or interfere with its secure routing infrastructure. We reserve the right to institute criminal and civil proceedings against any user who attempts to:
- Gain unauthorized access to our servers, infrastructure, or admin panels.
- Deliver, execute, or inject malicious code, viruses, or harmful scripts into the platform.
- Scrape, harvest, frame, or mirror our platform's layout or job listings without our express written permission.
5. Intellectual Property
All intellectual property including trade marks, names and logos, whether registered or not, embodied in the Website content, are the proprietary marks of us. Marks identifying third parties are owned or licensed by those third parties or their associated companies. Nothing in these terms and conditions in any way confers on you any licence or right under any trade marks, names or logos. Except as expressly permitted by these terms and conditions, you may not copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilise any of the contents of the Website or authorise any person, or procure any other person to do so. In particular, you may not cache any of the contents for access by third parties nor mirror or frame any of the content of the Website nor incorporate it into another website, or authorise or procure any other person to do so, without our express written permission. Any intellectual property embodied in the information provided by an advertiser and utilised on the Website is hereby assigned to us.
6. Third-Party Links
Our website contains vacancy listings and hypertext links to external corporate websites. We do not monitor, control, or endorse the content, uptime, or privacy practices of these third-party platforms and accept no responsibility for them.
7. Electronic Communications
By utilizing this website, submitting forms, or corresponding with us, you consent to receive communications from us electronically (via email or SMS) or telephonically. You agree that all electronic agreements, notices, and disclosures satisfy any legal requirement that such communications be "in writing.".

9. System Testing and Simulation (Important Notice)
From time to time, we carry out routine system updates, platform upgrades, and performance testing to ensure our secure routing infrastructure operates optimally.
- Test Listings:** For the purposes of system verification, technical testing, or capability assessments, we reserve the right to publish mock, dummy, or simulated job listings on the Website.
- Identification of Test Listings:** Where feasible, these listings will be clearly marked under the contact module with titles containing terms such as *"This Is A Test Job Listing,"* *"System Test,"* or *"Internal Simulation."*.
- Disclaimers regarding Applications: These test vacancies are entirely fictitious. Any applications, CV transmissions, or contact details submitted against an identified test listing will be automatically discarded by our system. We accept no liability for any candidate confusion, lost time, or data routed into testing pipelines due to submissions made on simulated test listings.
10. General
We reserve the right to assign or subcontract any or all of our rights and obligations under these terms and conditions to a third party. If we exercise this right, we shall name the assignee or subcontractor on the Website and you will be entitled to terminate the account within 5 working days of posting such notification on the Website. You may not without our prior written consent, assign or dispose of any rights or obligations arising under these terms and conditions. We may revise these terms and conditions at any time by amending this page. You are expected to check this page from time to time and take notice of any changes we made, as they are biding on you. Some provisions contained in these terms and conditions may also be superseded by provisions
or notices published elsewhere on the Website. If any of the provisions of the terms and conditions shall be held to be invalid or unenforceable, it shall not affect the enforceability of any of the remaining provisions. 11. Acceptable Use and Platform Abuse
We maintain a zero-tolerance policy for activities that compromise the integrity, security, or reputation of our marketplace ecosystem.
- Prohibited Content: Employers may not post listings that are fraudulent, misleading, or require candidates to pay upfront fees, purchase starter kits, or participate in multi-level marketing (MLM) schemes.
- Anti-Spam & Automated Submissions: Candidates may not use automated bots, scraping scripts, or mass-submitting software to spam employer job listings with multiple or fraudulent applications.
- Right of Termination: We reserve the absolute right, at our sole discretion and without prior notice, to permanently delete any job listing, suspend platform access, or block any IP address found to be violating these terms, engaging in abusive behavior, or disrupting our data routing infrastructure.
12. Platform as a Service (PaaS)
This platform functions strictly as a digital job advertising medium. We provide a space for employers to post advertisements for available vacancies and for work-seekers to view those postings.
Employer Advertising Terms & Conditions.
These Employer Advertising Terms & Conditions ("Advertising Terms") govern all vacancy listings, banners, and promotional placements ("Advertisements") submitted by corporate entities, recruiters, or individuals ("Advertisers") for publication on the HR Partner platform, including its desktop website, mobile interfaces, and partner distribution networks.
By submitting or paying for an Advertisement on our platform, you acknowledge that you have read, understood, and agree to be bound by these legally binding terms.
1. Non-Transferability of Advertising Slots
The advertising privileges, dashboard allocations, and listing slots granted under these terms are strictly specific to your corporate entity. Advertisers may not transfer, resell, assign, or outsource any of their advertising rights or contractual obligations to a third party without our prior written authorization.
2. Multi-Posting Limits & Listing Duplication
- One Role Per Listing: To maintain data integrity for work-seekers, each Advertisement may feature only one distinct job position or vacancy title at any given time.
- Subsequent Overwrites: If you upload a new or updated Advertisement for a vacancy that is already live on the platform, the new submission will overwrite and replace the previous listing.
- Forfeiture of Remaining Duration: Upon replacement, the active duration cycle of the original listing immediately expires. We are under no obligation to refund, credit, or reimburse you for any unused portions of the initial advertising cycle if you choose to overwrite or remove it early.
3. Payment Processing & Rate Modifications
- Upfront Billing: All Advertisements must be settled in full prior to publication at our current prevailing commercial rates. We reserve the absolute right to withhold or pause the publication of any vacancy listing until cleared payment is confirmed.
- Rate Revisions: We reserve the right to modify our commercial advertising rates at our sole discretion. Adjusted rates will apply solely to new or renewed Advertisements placed after the revised prices are updated on our billing platforms.
- EFT Clearance Requirement: Where payment is made via EFT, Advertisements will not be processed or released to the live marketplace until the funds have completely cleared and reflect in our bank account. Proof of payment (POP) notifications may be submitted, but system activation remains subject to actual bank clearance.
4. Review, Processing, and Activation Timelines
- SLA Windows: We aim to process, vet, and approve digital job advertisements submitted via our online dashboard within 48 hours of submission. Approved vacancies will go live on the platform on the following business day.
- Status Notifications: Upon successful review and deployment, an automated system confirmation will be issued to your registered corporate email address indicating that the listing is live.
- Rejected Listings: If an Advertisement fails our internal moderation policies, we will communicate the rejection via email, providing directional guidance or a contact path to resolve the compliance issue.
5. Advertiser Warranties & Regulatory Compliance
As an Advertiser, you expressly warrant and guarantee that:
- Data Integrity: All text, organizational descriptions, logos, and salary indicators provided are comprehensive, legally sound, non-defamatory, truthful, and strictly compliant with the South African Code of Advertising Practice.
- Third-Party Indemnity: The publication of your Advertisement will not infringe upon the intellectual property, copyright, or trademark rights of any third party, nor expose HR Partner to legal liabilities, regulatory fines, or reputational damage.
- Privacy & POPIA Compliance: Where a job description, video link, or logo identifies or relates to any living individual, you have secured the explicit, informed consent of that person in strict compliance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA).
6. Immediate Takedown and Suspension Rights
We retain the absolute right to suspend, archive, or permanently delete any Advertisement with immediate effect, without notice or financial liability to you, if:
- You breach any warranty outlined in Section 5, or we have reasonable grounds to suspect your listings are fraudulent, misleading, or harvesting candidate data under false pretenses.
- Undisclosed Placement Fees or Data Harvesting: The Advertisement requires candidates to pay upfront administrative fees, application costs, vetting fees, or mandatory training costs to secure an interview, or if we discover the listing was published solely to illegally harvest candidate personal profiles rather than fill a genuine, active vacancy.
- A competent South African law enforcement agency, statutory body, or labor compliance authority instructs, recommends, or issues a takedown directive regarding your published content.
